Coachopt provides an administrative and athlete monitoring tool adapted for sports teams and sports organizations. These services is provided by CoachOpt AB. These Terms of Use govern all potential users’ use of our services. ”Our services” means all software, platforms, systems and information used to provide Coachopt’s services. By using our services you agree to these terms and conditions (the Terms). Please read them carefully.

1. General

1.1 Security

We take reasonable measures to protect your personal information from unauthorized access, disclosure, or destruction. However, no security system is completely foolproof, and we cannot guarantee the security of your personal information.

1.2 Links to Other Websites

Our platforms may contain links to other websites. We are not responsible for the privacy practices or content of these websites. We encourage you to review the privacy policies of these websites before providing any personal information.

1.3 Intellectual Property

All content on our platforms, including text, graphics, logos, and images, is the property of CoachOpt AB and is protected by copyright and other intellectual property laws. You may not use or reproduce any content from our platforms without our express written permission.

1.4 Disclaimer of Warranties

Our services is provided on an as-is and as available basis, without any warranties of any kind, express or implied. We do not warrant that our services will be uninterrupted or error-free, or that any defects will be corrected.

1.5 Limitation of Liability

In no event shall CoachOpt AB be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of our services, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses.

1.6 Changes to the Terms

We may modify these Terms at any time by posting the revised Terms on our website. Your continued use of our services after any such changes constitutes your acceptance of the revised Terms.

1.7 Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Sweden. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Sweden.

2. Privacy Policy

This Privacy Policy explains how we collect, use, and disclose personal information that we obtain from users of our services. By using our services, you consent to the collection, use, and disclosure of your personal information as described in this Privacy Statement.

2.1 Information We Collect

We may collect personal information from you when you visit our platforms, create an account, fill out a form, or interact with our platforms in other ways. The types of personal information we may collect include:

  • Name
  • Email address
  • Phone number
  • Payment information
  • Information about your use of our website

In addition to this, our platforms makes it possible for athletes to submit data through different types of athlete reports. The data that is requested in the athlete reports is configurable by the athletes team and organisation administrators. By submitting data through these athlete reports, the submitting user acknowledge that this data can be read by the users team and organisation administrators. CoachOpt AB is not responsible for the design or suitability of these form parameters and form questions. By submitting data via these forms, the user consents to that data being handled via CoachOpt’s servers, systems and our platforms. We may also collect non-personal information such as your IP address, browser type, and operating system.

2.2 How We Use Your Information

We may use your personal information for the following purposes:

  • To provide and improve our services
  • To communicate with you about our services and promotions
  • To process payments and orders
  • To respond to your inquiries and requests
  • To comply with legal and regulatory requirements

Data obtained through athlete reports may be used in anonymized form for statistical purposes. We may also use other non-personal information for statistical purposes and to improve our services.

2.3 Disclosure of Your Information

We may disclose your personal information to third parties for following purposes along with the other purposes described later in this section:

  • To provide and improve our services
  • To process payments and orders
  • To comply with legal and regulatory requirements

To assist us in providing services to you, we engage other companies, agents or suppliers (referred to as Service Providers”) who perform services on our behalf. These Service Providers may include providers of communication, security, infrastructure and IT ser- vices. They also help us customize and optimize our services, process payment methods, provide customer service and analyze and improve information about users’ interactions with the service. In the course of providing these services, these third-party companies may have access to your personal data or other information. However, we do not permit them to use or disclose your personal data for any other purpose other than providing the requested services (including maintaining and improving those services). The information acquired from athlete reports is, in a personally identifiable manner, only accessible to the team administrators and organization administrators. We may also disclose your personal information if required by law or in connection with a legal claim or proceeding. If we undergo any reorganization, restructuring, merger, sale or transfer of assets, we may transfer information, including your personal data, to the receiving party, subject to their agreement to protect your personal data in accordance with our Privacy Statement.

2.4 Your Information and your rights

We comply with the laws and regulations specified in the the European Regulation GDPR. The GDPR is a regulation that aims to protect the privacy of EU citizens by regulating how personal data is collected, processed, and stored.

2.4.1 Your rights

You have the rights to access, correct, erase, obtain, object to the processing of and not be subject to automated decision-making of your personal data. Personal data is defined by the General Data Protection Regulation (GDPR) as any information that can be used to directly or indirectly identify a living person, such as a name, identification number, location data, online identifier, or other factors that relate to the physical, physiological, genetic, mental, economic, cultural, or social identity of an individual.

2.4.2 In case of a data breach

If CoachOpt would experience a data breach that is likely to result in a risk to the rights and freedoms of our users, we will notify the supervisory authority as well as affected users without undue delay.

2.4.3 International Data transfers

If a case would occur where CoachOpt would transfer personal data to countries outside the EU, CoachOpt will ensure that the recipient country provides an adequate level of data protection.

This Data Retention Policy outlines our procedures for retaining and deleting personal information collected by our services. By using our services, you consent to the collection, use, and retention of your personal information as described in this policy.

4.1 Data Retention

We will retain your personal information for as long as necessary to fulfill the purposes for which it was collected, as well as for any legal or regulatory requirements. We will not keep your personal information longer than necessary for the purpose it was collected or as required by law. In determining how long to retain personal information, we consider the amount, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure of the information, the purposes for which we process the information, and whether we can achieve those purposes through other means. When personal information is no longer needed, we will securely delete or destroy it in a manner that ensures that it cannot be accessed or used for unauthorized purposes.

4.2 Data Backup and Recovery

We will take reasonable steps to ensure the security and integrity of personal information collected through our website. We will implement appropriate technical and organizatio- nal measures to protect personal information against accidental or unlawful destruction, loss, alteration, unauthorized disclosure, or access. We will also maintain appropriate backup and disaster recovery processes to ensure that personal information can be restored in the event of a data breach or loss.

4.3 Data Access and Deletion Requests

You have the right to access, correct, and delete your personal information that we have collected. You also have the right to object to the processing of your personal information and to withdraw your consent at any time. We will respond to your request as soon as reasonably possible and in accordance with applicable law.

5. Licenses and subscriptions

5.1 Organization, Team and User structure

Coachopt’s structure is built upon organizations, teams and athletes. An athlete can be a member of one or more teams and a team is always linked to an organization. An organization can consist of several teams. When a subscription with a certain number of licenses is purchased, an organization is created in Coachopt’s system. A user account is created for the buyer and that user account is registered as the organization owner. The organization owner can create one or more teams in their organization. The organization owner distributes their purchased licenses across the organization’s teams. The organization owner can invite users via email to become either organization administrators for the organization or team administrators for a specific team. If the invited user does not already have a Coachopt user profile, a profile is created upon acceptance of the invitation. Organization administrators have administrative rights for all teams in the organization. Team administrators can invite users via email to become a member of a team, these members assume the role of athlete in that team. If the invited user does not already have a Coachopt user profile, a profile is created upon acceptance of the invitation.

5.2 License policy

The organization owner occupies one subscription license. All organization administrators occupies one subscription license each. A team administrator occupies one subscription license for each team for which that user is an administrator. An athlete occupies one subscription license for each team of which it is a member.

5.3 Subscription policy

You can cancel your subscription at any time. You will have continued access to the service until the end of your billing period. Refunds are not offered for paid subscription periods or for unused licenses. It is possible to add licenses during a subscription period. It is not possible to reduce the number of licenses during a paid subscription period.
